We advise our clients on the competition law implications of the agreements they sign while performing their respective activities, both agreements of a horizontal nature (specialisation and cooperation agreements and joint ventures, for example) and those of a vertical nature (distribution, agency and franchising agreements, for instance).
In the domain of abuse of dominant position, Morais Leitão’s activity is centred on legal advice to companies that occupy strong positions in the markets where they have a presence. We do not only address strategic questions arising from day-to-day activity but we also forewarn in an attempt to minimise the risks of abusive exploitation of those companies’ positions. We also provide assistance to companies affected by abusive practices.
In this context we have represented clients in several complex investigations initiated by the Competition Authority and by the European Commission, as well as in judicial appeals against condemnatory decisions of these authorities to the European and Portuguese courts.
