Legal Alert | RGPC Platform - Coming into operation

On 25 November 2024, the RGPC Platform, created by MENAC for the submission of documents required by the General Regime for the Prevention of Corruption, went live. Registration is mandatory until 31 December 2024, and public or private entities must comply with the requirements under penalty of sanctions.

On 25 November 2024, the RGPC Platform, created and launched by the National Anti-Corruption Mechanism (MENAC), entered into operation. 

The RGPC Platform was established as part of the General Regime for the Prevention of Corruption (RGPC)1, with the aim of providing a tool for submitting documents on the regulatory compliance instruments provided for in the RGPC, to promote and strengthen integrity and transparency practices.

Access to the RGPC Platform may only be provided by prior registration of the entity covered by the computer system supporting MENAC's activity.

It should be noted that the public entities covered and registered in the IT support system for MENAC activity can rely on automatic pre-registration of access. Instructions for this will be sent to the e-mail they provided to the Directorate-General for Administration and Public Employment.

Public entities which do not receive this communication, due to possible non-compliance with the pre-registration requirements, and in all cases the private entities covered, must send a request for access to the e-mail address registo@mec-anticorrupcao.pt, with the items listed in Article 12 of the RGPC Platform Regulation, namely: (i) the full name of the entity; (ii) the entity's legal person identification number (if applicable) and SIOE Code (if applicable); and (iii) the official e-mail address of the entity2.

All entities concerned shall register with the RGPC Platform by 31 December 2024, and submit all documents relating to the compliance programme they have implemented (i.e. the approved risk prevention plan for corruption and related offences, the code of conduct that has been adopted, etc.). Any entity that has already sent this documentation to MENAC by other means must submit the most recent versions of each document on the RGPC Platform3.

In the event of non-compliance, public and private entities may be subject to sanctions, under the RGPC sanctioning regime.
