David Silva Ramalho comments to Observador newspaper on the arrest of Telegram's CEO
David Silva Ramalho, commenting to Observador on the arrest of Pavel Durov, CEO of Telegram, reveals that this situation is unusual and raises questions about the CEO's responsibility in relation to crimes that may occur on the platform.
‘There is talk of the CEO being involved in trafficking offences and child abuse because he didn't take the necessary measures to stop the channels where these activities take place. But from my perspective, it doesn't make much sense to arrest the CEO for committing these crimes. It's one thing not to take the appropriate measures to prevent the platform from being used for these purposes or even to refuse to collaborate with organisations when collaboration is required, but it's quite another to consider that, by not taking the measures, he is taking part in the execution of the crimes.’
The Morais Leitão lawyer also emphasises the tension between public security and user privacy, noting that Telegram has a history of not cooperating with the authorities, which adds to the complexity of the case.
