João Tiago Silveira signs the article ‘The Reform of Administrative Litigation: new challenges twenty years on’
João Tiago Silveira, a partner at Morais Leitão, writes the article ‘The Administrative Litigation Reform: new challenges twenty years on’, in which he reflects on the progress made and the problems still to be solved in this branch of the law. The lawyer emphasises that the reform, implemented in 2004 after extensive public discussion, was essential in overcoming structural limitations such as the lack of adequate procedural means, excessive formalism and the lack of effective injunctive relief.
Despite the progress made, João Tiago Silveira draws attention to the current challenges, such as the backlog of cases, which in 2023 exceeded 33,000, and the slowness in resolving administrative actions, with average decision times reaching 37 months. The Morais Leitão partner defends the need for greater use of the management mechanisms provided for in the law and points to solutions such as strengthening administrative arbitration and introducing innovative measures for procedural management.
In the article, the author proposes specific legislative interventions and changes in court management to tackle the problems of speed and efficiency, stressing the importance of continuing to modernise the system and bring it closer to the needs of citizens and businesses.
