In an interview with Commercial Dispute Resolution (CDR) Magazine, as part of the Global Class Actions Symposium event, Sofia Vaz Sampaio, partner at Morais Leitão, talks about the growth of class actions in Portugal, highlighting the impact of the ‘opt-out’ regime on the significant increase in class actions in the country. According to the lawyer, Portugal has become an attractive destination for class actions due to the ease of initiating proceedings without a preliminary certification phase, forcing defendants to defend themselves immediately.
However, Sofia Vaz Sampaio expresses concerns about the increase in abusive litigation and argues that the introduction of an ‘opt-in’ system could bring balance to the system, guaranteeing both access to justice and the prevention of abuse.
