Tiago Félix da Costa, Rui Patrício, Tiago Geraldo and Tiago Monfort analyse the challenges of fighting corruption in Portugal
Morais Leitão's lawyers shared their views on the effectiveness of Portugal's anti-corruption mechanisms and the measures included in the anti-corruption agenda of the 2025 State Budget.
Rui Patrício stressed that the existing mechanisms are "more than sufficient" and considered that the new legislative proposals represent an "evolution in continuity" without bringing significant structural changes. For the lawyer, excessive criminalisation and increased penalties do not always contribute to an effective solution to the problem.
Tiago Félix da Costa stressed the need to improve the management of resources and the practical evaluation of the measures implemented, arguing that "we don't need more or more of the same, we need the same in a better way". The partner also stressed the fundamental role of lawyers in preventing corrupt practices by assisting companies with their compliance and risk management policies.
Tiago Geraldo, for his part, warned against the inefficiency of mega trials and advocated a more pragmatic approach and a "refocusing on the essentials". He stressed that prevention should be the priority, through incentives for self-monitoring and spontaneous reporting.
Tiago Monfort addressed the regulation of lobbying, which is included in the Anti-Corruption Agenda, and considered that it could help to clarify the rules and prevent possible excesses, but stressed that the lack of regulation is not the source of the problem.
The lawyers also stressed the importance of a more efficient judicial system, with better conditions and resources, to strengthen the credibility of the fight against corruption and to attract foreign investment to Portugal.
