Inês Meneses Lampreia publishes dissertation on patentability of Artificial Intelligence inventions
Inês Meneses Lampreia, a trainee lawyer in the corporate real estate and tourism team, has just had her master's dissertation published.
The work, entitled ‘When the invention becomes the inventor: the patentability of inventions generated by Artificial Intelligence systems’, was defended in November last year as part of the Master's in Business Law at the Portuguese Catholic University (UCP) in Lisbon.
The dissertation was published by UCP Editora and is part of the ‘Direito Católica Teses’ collection, which has the support of the Miguel Galvão Teles Institute (IMGT).
The dissertation ‘seeks to assess the patentability of inventions generated by Artificial Intelligence (AI) systems with inventive capacity. Firstly, the concept of patent and its requirements are explored, followed by a comparative analysis of moral rights in patent law and copyright law, and a distinction between types of inventions obtained using AI systems. Subsequently, the legal rules regarding the concept of inventor are analysed, with support from the case law of the DABUS case, concluding that there are three ways of responding to the admissibility of the patentability of these inventions. Finally, a reflection is made on the inherent social and technological consequences.’
