Private Enforcement in Portugal

Sofia Vaz Sampaio and Leonor Martins Machado and Gonçalo Machado Borges (alumnus) are the authors of the chapter "Private Enforcement in Portugal", published in the New Digital Markets Act Practical Guide.

This chapter is dedicated to the private enforcement of the Digital Markets Act (DMA). It discusses the possibility of the DMA (Digital Markets Act) being the subject of private enforcement actions and analyses, in the light of Portuguese law, the conditions and legal bases that allow end users and professional users to bring actions for damages against access controllers for breach of obligations under the DMA.
