Role of the Portuguese Supreme Court in the Interpretation and Application of the Labour Law

Isabel Valente Dias, together with the Judge and President of the Portuguese Constitutional Court, José João Abrantes, signs the article "Role of the Portuguese Supreme Court in the Interpretation and Application of the Labour Law" integrated in the recent publication "The Impact of the Supreme Courts on the Development of Labour Law in Europe".

"Over the years, the Supreme Court of Justice has influenced the evolution of Labour Law in Portugal, contributing to the interpretation of the law and the resolution of some controversial labour issues.
The jurisprudence of the Supreme Court of Justice reveals a set of guidelines on how the provisions of Labour Law should be interpreted and applied in practice.
This chapter seeks to give a brief overview of some innovative case law issued by the Social Section of the Supreme Court of Justice, particularly after the entry into force of the (first) Portuguese Labour Code in 2003".
