Tiago Geraldo and Nuno Igreja Matos participate, as authors, in the publication "Fairness in Criminal Appeal - A critical and interdisciplinary analysis of the ECHR Case-Law", coordinated by Helena Morão and Ricardo Tavares da Silva, in a Springer edition.
The work promotes a study around the principle of immediacy in criminal proceedings. With this purpose, in addition to interdisciplinary approaches to the principle and the future challenges it faces regarding technological developments, the book develops an analysis of the jurisprudence of the European Court of Human Rights in the field of criminal procedural remedies and seeks to establish links between the criteria of this European Court and the practices in force in the national courts of Portugal, Spain and Italy.
The lawyers write the chapter entitled "The recordings model in Portugal: the defendant's and the victim's perspectives". Throughout the text, they examine the current rules and the understandings of the Portuguese courts regarding immediacy at the appeal stage, pondering their implications from the defendant's and the assistant's perspective. A global analysis is also carried out to discover whether the practice of the Portuguese courts complies or fails to comply with the rules and standards set by the European Court of Human Rights.
